Whereas the Canadian Radio-television and Telecommunications Commission (“the Commission”) rendered Broadcasting Decisions CRTC 2005-338 and CRTC 2005-339 on July 21, 2005, which respectively approved the applications by I.T. Productions Ltd. for a broadcasting licence to operate a new ethnic AM radio station at Vancouver operating at a frequency of 1200 kHz and by South Asian Broadcasting Corporation Inc. for a broadcasting licence to operate a new commercial specialty FM (ethnic) radio station at Vancouver operating at a frequency of 93.1 MHz;
Whereas, subsequent to the rendering of the Decisions, the Governor in Council received petitions requesting that the Decisions be set aside or referred back to the Commission for reconsideration and hearing of the matters;
And whereas the Governor in Council, having considered the petitions, is not satisfied that the Decisions derogate from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside Broadcasting Decisions CRTC 2005-338 and CRTC 2005-339 of July 21, 2005, or refer them back to the Commission for reconsideration and hearing.
Attendu que le Conseil de la radiodiffusion et des télécommunications canadiennes (le « Conseil ») a, dans ses décisions de radiodiffusion CRTC 2005-338 et CRTC 2005-339 du 21 juillet 2005, approuvé chacune des demandes de licence de radiodiffusion présentées respectivement par I.T. Productions Ltd. en vue d'exploiter une nouvelle station de radio AM (à caractère ethnique) à Vancouver à la fréquence 1 200 kHz et par South Asian Broadcasting Corporation Inc. en vue d'exploiter une nouvelle station de radio FM commerciale spécialisée (à caractère ethnique) à Vancouver à la fréquence 93,1 MHz;
Attendu que la gouverneure en conseil, à la suite de ces décisions, a reçu des demandes requérant leur annulation ou leur renvoi au Conseil pour réexamen et nouvelle audience;
Attendu que la gouverneure en conseil, ayant tenu compte de ces demandes, n'est pas convaincue que ces décisions ne vont pas dans le sens des objectifs de la politique canadienne de radiodiffusion énoncés au paragraphe 3(1) de la Loi sur la radiodiffusion,
À ces causes, sur recommandation de la ministre du Patrimoine canadien et en vertu de l'article 28 de la Loi sur la radiodiffusion, Son Excellence la Gouverneure générale en conseil refuse d'annuler ou de renvoyer au Conseil pour réexamen et nouvelle audience les décisions de radiodiffusion CRTC 2005-338 et CRTC 2005-339 du 21 juillet 2005.
