Whereas the Canadian Radio-television and Telecommunications Commission (“the Commission”) approved, in Broadcasting Decision CRTC 2008-222 of August 26, 2008, the application by Astral Media Radio inc. for a broadcasting licence to operate an English-language commercial FM radio programming undertaking to serve Ottawa and Gatineau operating on the frequency 99.7 MHz, channel 259C1, with an average effective radiated power of
45 000 watts;
Whereas, subsequent to the making of the decision, the Governor in Council received petitions requesting that the decision to approve the application by Astral Media Radio inc. be set aside or referred back to the Commission for reconsideration and hearing of the matter;
Whereas, in considering those petitions, the Governor in Council has had regard to Part VII of the Official Languages Act;
And whereas the Governor in Council, having considered those petitions, is satisfied that the decision to approve the application by Astral Media Radio inc. derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act, and in particular paragraphs 3(1)(b), (c) and (k) of that Act;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act,
(a) hereby refers back to the Commission for reconsideration and hearing Broadcasting Decision CRTC 2008-222 of
August 26, 2008, with respect to the application for a broadcasting licence by Astral Media Radio inc. to operate an English-language commercial FM radio programming undertaking to serve Ottawa and Gatineau; and

(b) is of the opinion that it is material to the reconsideration and hearing that the Commission fully consider and explain its approach to evaluating the needs of official-language minority communities and how it applies in this case.
Attendu que le Conseil de la radiodiffusion et des télécommunications canadiennes (le « Conseil ») a, dans sa décision de radiodiffusion CRTC 2008-222 du 26 août 2008, approuvé la demande de licence de radiodiffusion d’Astral Media Radio inc. en vue de l’exploitation d’une entreprise de programmation de radio FM commerciale de langue anglaise à O ttawa et à Gatineau à la fréquence 99,7 MHz, canal 259C1, avec une puissance apparente rayonnée moyenne de 45 000 watts;
Attendu que la gouverneure en conseil, à la suite de cette décision, a reçu des requêtes demandant l'annulation de la décision d’approuver la demande de licence de radiodiffusion d’Astral Media Radio inc. ou son renvoi au Conseil pour réexamen et nouvelle audience;
Attendu que, en examinant ces requêtes, la gouverneure en conseil a tenu compte de la partie VII de la Loi sur les langues officielles;
Attendu que la gouverneure en conseil, après avoir examiné ces requêtes, est convaincue que la décision d’approuver la demande d’Astral Media Radio inc. ne va pas dans le sens des objectifs de la politique canadienne de radiodiffusion énoncés au paragraphe 3(1) de la Loi sur la radiodiffusion, notamment aux alinéas 3(1)b), c) et k),
À ces causes, sur recommandation du ministre du Patrimoine canadien et en vertu de l'article 28 de la Loi sur la radiodiffusion, Son Excellence la Gouverneure générale en conseil :
a) renvoie au Conseil pour réexamen et nouvelle audience la décision de radiodiffusion CRTC 2008-222 du 26 août 2008 en ce qui a trait à la demande de licence de radiodiffusion d’Astral Media Radio inc. en vue de l’exploitation d’une entreprise de programmation de radio FM commerciale de langue anglaise à Ottawa et à Gatineau;

b) est d'avis qu'il est essentiel que, dans le cadre de son réexamen et de sa nouvelle audience, le Conseil étudie et explique à fond sa façon d’évaluer les besoins des communautés de langue officielle en situation minoritaire et comment cela s’applique dans le cas présent.
