Whereas the Governor in Council is of the opinion that

(a) based on the declaration of a pandemic by the World Health Organization, there is an outbreak of a communicable disease, namely coronavirus disease 2019 (COVID-19), in the majority of foreign countries;

(b) the introduction and spread of the disease poses an imminent and severe risk to public health in Canada;

(c) the entry of persons into Canada who have recently been in a foreign country may introduce or contribute to the spread of the disease in Canada; and

(d) no reasonable alternatives to prevent the introduction or spread of the disease are available;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to section 58 of the Quarantine Act, makes the annexed Order Amending the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Mandatory Isolation), No. 2.

Attendu que la gouverneure en conseil est d’avis :

a) que, compte tenu de la déclaration de pandémie de l’Organisation mondiale de la santé, la majorité des pays étrangers est aux prises avec l’apparition d’une maladie transmissible, soit la maladie à coronavirus 2019 (COVID-19);

b) que l’introduction et la propagation de cette maladie présentent un danger grave et imminent pour la santé publique au Canada;

c) que l’entrée au Canada de personnes qui ont récemment séjourné dans un pays étranger favoriserait l’introduction ou la propagation de la maladie au Canada;

d) qu’il n’existe aucune autre solution raisonnable permettant de prévenir l’introduction ou la propagation de la maladie au Canada,

À ces causes, sur recommandation de la ministre de la Santé et en vertu de l’article 58 de la Loi sur la mise en quarantaine, Son Excellence la Gouverneure générale en conseil prend le Décret modifiant le Décret n^o 2 visant la réduction du risque d’exposition à la COVID-19 au Canada (obligation de s’isoler), ci-après.

Order Amending the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Mandatory Isolation), No. 2

Amendments

1 The definition quarantine in section 1 of the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Mandatory Isolation), No. 2¹ is replaced by the following:

quarantine means separation of persons from others in such a manner as to prevent the possible spread of infection or contamination. (quarantaine)

2 Paragraph 4(1)(c) of the English version of the Order is replaced by the following:

(c) where they will have access to the necessities of life.

3 Paragraph 6(f) of the Order is replaced by the following:

(f) a person or any person in a class of persons whose presence in Canada is determined by the Minister of Foreign Affairs, the Minister of Citizenship and Immigration or the Minister of Public Safety and Emergency Preparedness to be in the national interest, as long as the person complies with any conditions imposed on them by that Minister to minimize the risk of introduction or spread of COVID-19;

4 The Order is amended by adding the following after section 6:

Consultation with Minister of Health

6.1 Conditions that are imposed under paragraph 6‍(f) must be developed in consultation with the Minister of Health.

5 Subparagraph 10(1)(b)(iii) of the English version of the Order is replaced by the following:

(iii) where they will have access to the necessities of life.

Coming into Force

6 This Order comes into force at 23:59:59 p.m. Eastern Daylight Time on the day on which it is made.

Décret modifiant le Décret n^o 2 visant la réduction du risque d’exposition à la COVID-19 au Canada (obligation de s’isoler)

Modifications

1 La définition de quarantaine à l’article 1 du Décret n^o 2 visant la réduction du risque d’exposition à la COVID-19 au Canada (obligation de s’isoler)¹ est remplacée par ce qui suit :

quarantaine Mise à l’écart de personnes de façon à prévenir la propagation éventuelle de l’infection ou la contamination. (quarantine)

2 L’alinéa 4(1)c) de la version anglaise du même décret est remplacé par ce qui suit :

c) where they will have access to the necessities of life.

3 L’alinéa 6f) du même décret est remplacé par ce qui suit :

f) la personne dont la présence au Canada est, individuellement ou au titre de son appartenance à une catégorie de personnes, comme l’établit le ministre des Affaires étrangères, le ministre de la Citoyenneté et de l’Immigration ou le ministre de la Sécurité publique et de la Protection civile, dans l’intérêt national, tant que cette personne respecte les conditions qui lui sont imposées par le ministre pour minimiser le risque d’introduction et de propagation de la COVID-19;

4 Le même décret est modifié par adjonction, après l’article 6, de ce qui suit :

Consultation avec le ministre de la Santé

6.1 Les conditions imposées en vertu de l’alinéa 6f) sont élaborées en consultation avec le ministre de la Santé.

5 Le sous-alinéa 10(1)b)(iii) de la version anglaise du même décret est remplacé par ce qui suit :

(iii) where they will have access to the necessities of life.

Entrée en vigueur

6 Le présent décret entre en vigueur à 23 h 59 min 59 s, heure avancée de l’Est, le jour de sa prise.
