Whereas the Governor in Council is of the opinion, based on the declaration of a pandemic by the World Health Organization, that there is an outbreak of a communicable disease, namely coronavirus disease 2019 (COVID-19), in the majority of foreign countries;

 

Whereas the Governor in Council is of the opinion that the introduction or spread of COVID-19 would pose an imminent and severe risk to public health in Canada;

 

Whereas the Governor in Council is of the opinion that the entry of persons into Canada who have recently been in a foreign country may introduce or contribute to the spread in Canada of COVID-19 or of new variants of the virus causing COVID-19 that pose risks that differ from those posed by other variants but that are equivalent or more serious;

 

And whereas the Governor in Council is of the opinion that no reasonable alternatives to prevent the introduction or spread of COVID-19 are available;

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to section 58 of the Quarantine Act, makes the annexed Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada — Specified Countries).


 

Attendu que la gouverneure en conseil est d’avis, compte tenu de la déclaration de pandémie de l’Organisation mondiale de la santé, que la majorité des pays étrangers est aux prises avec l’apparition d’une maladie transmissible, soit la maladie à coronavirus 2019 (COVID-19);

 

Attendu que la gouverneure en conseil est d’avis que l’introduction ou la propagation de la COVID-19 présenterait un danger grave et imminent pour la santé publique au Canada;

 

Attendu que la gouverneure en conseil est d’avis que l’entrée au Canada de personnes qui ont récemment séjourné dans un pays étranger pourrait favoriser l’introduction ou la propagation au Canada de la COVID-19 ou de nouveaux variants du virus qui cause la COVID-19, lesquels présentent des risques qui sont différents de ceux présentés par d’autres variants, mais qui sont équivalents ou plus graves;

 

Attendu que la gouverneure en conseil est d’avis qu’il n’existe aucune autre solution raisonnable permettant de prévenir l’introduction ou la propagation de la COVID-19 au Canada,

 

À ces causes, sur recommandation du ministre de la Santé et en vertu de l’article 58 de la Loi sur la mise en quarantaine, Son Excellence la Gouverneure générale en conseil prend le Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada — pays visés), ci-après.

 


Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada — Specified Countries)

1 The following definitions apply in this Order.

Chief Public Health Officer has the same meaning as in section 2 of the Public Health Agency of Canada Act. (administrateur en chef)

foreign national has the same meaning as in subsection 2‍(1) of the Immigration and Refugee Protection Act. (étranger)

Omicron variant means the SARS-CoV-2 variant B.1.1.529, designated as a variant of concern and named Omicron by the World Health Organization. (variant Omicron)

Quarantine Order means the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Quarantine, Isolation and Other Obligations). (Décret visant la quarantaine)

2 This Order applies in addition to the prohibitions and requirements set out in the Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States), Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from any Country Other than the United States) and the Quarantine Order.

3(1) A foreign national is prohibited from entering Canada if, within a period of 14 days before the day on which they seek to enter Canada, they were in a country where, as determined by the Chief Public Health Officer,

(a) there is an outbreak of the Omicron variant; or

(b) there is a risk of an outbreak of that variant.


 

Factors

(2) For the purposes of subsection (1), the Chief Public Health Officer must consider the following factors:

(a) any scientific evidence and other data indicating that COVID-19 or the Omicron variant could pose an imminent and severe risk to public health in Canada;

(b) any scientific evidence and other data relating to an outbreak of the Omicron variant or the risk of an outbreak of that variant in the foreign country; and

(c) any declaration by international organizations such as the World Health Organization concerning an outbreak of the Omicron variant and the imminent and severe risk that it poses to public health.

Non-application

4 Section 3 does not apply to

(a) a person registered as an Indian under the Indian Act;

(b) a protected person, as defined in subsection 95‍(2) of the Immigration and Refugee Protection Act;

(c) a person who is on board an aircraft bound for Canada or in transit to their final destination in Canada at the time when there is a determination made in accordance with subsection 3‍(1) in respect of the country they were in within a period of 14 days before the day on which they seek to enter Canada;

(d) a person or any person in a class of persons whose presence in Canada, as determined by the Minister of Health, is in the national interest;

(e) a person who enters Canadian waters, including the inland waters, or the airspace over Canada on board a conveyance while proceeding directly from one place outside Canada to another place outside Canada, if the person was continuously on board that conveyance while in Canada and

(i) in the case of a conveyance other than an aircraft, the person did not land in Canada and the conveyance did not make contact with another conveyance, moor or anchor while in Canadian waters, including the inland waters, other than anchoring carried out in accordance with the right of innocent passage under international law, or

(ii) in the case of an aircraft, the conveyance did not land while in Canada; or

(f) a person who arrives by means of a vessel, as defined in section 2 of the Canada Shipping Act, 2001, if the vessel departed no later than the day on which this Order is made and had a scheduled destination of Canada upon its departure.

Powers and Obligations

Quarantine Act

5 For greater certainty, this Order does not affect any of the powers and obligations set out in the Quarantine Act.

Cessation of Effect

January 31, 2022

6 This Order ceases to have effect at 00:01:00 Eastern Standard Time on January 31, 2022.

2 Le présent décret s’applique outre les interdictions et les exigences prévues par le Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada en provenance des États-Unis), le Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada en provenance d’un pays étranger autre que les États-Unis) et le Décret visant la quarantaine.

3(1) Il est interdit à tout étranger d’entrer au Canada si, dans les quatorze jours précédant le jour où il cherche à y entrer, il s’est trouvé dans un pays qui, selon ce que conclut l’administrateur en chef :

a) soit est aux prises avec l’apparition du variant Omicron;

b) soit est à risque d’être aux prises avec l’apparition de ce variant.


 

Facteurs

(2) Pour l’application du paragraphe (1), l’administrateur en chef tient compte des facteurs suivants :

a) toute preuve scientifique ou toutes autres données indiquant que la COVID-19 ou le variant Omicron pourrait présenter un danger imminent et grave pour la santé publique au Canada;

b) toute preuve scientifique ou toutes autres données concernant l’apparition ou le risque d’apparition du variant Omicron dans le pays;

c) toute déclaration faite par des organisations internationales, telle l’Organisation mondiale de la santé, concernant l’apparition du variant Omicron et le danger grave et imminent pour la santé publique que pose ce dernier.

Non-application

4 L’article 3 ne s’applique pas aux personnes suivantes :

a) la personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens;

b) la personne protégée au sens du paragraphe 95‍(2) de la Loi sur l’immigration et la protection des réfugiés;

c) la personne qui est à bord d’un aéronef pour un vol à destination du Canada ou en transit vers une destination finale au Canada au moment où l’administrateur en chef conclut, aux termes du paragraphe 3‍(1), que le variant Omicron est apparu dans le pays dans lequel elle s’est trouvée dans les quatorze jours précédant le jour où elle cherche à entrer au Canada;

d) la personne dont la présence au Canada est, individuellement ou au titre de son appartenance à une catégorie de personnes, dans l’intérêt national, selon ce que conclut le ministre de la Santé;

e) la personne qui, à bord d’un véhicule, se rend directement d’un lieu à l’extérieur du Canada à un autre lieu à l’extérieur du Canada en passant par les eaux canadiennes, y compris les eaux internes, ou dans l’espace aérien du Canada, si elle est demeurée à bord du véhicule alors qu’il se trouvait au Canada et :

(i) s’agissant d’un véhicule autre qu’un aéronef, si elle n’a pas mis pied au Canada et que le véhicule n’a ni amarré, ni mouillé l’ancre, ni établi de contact avec un autre véhicule alors qu’il se trouvait dans les eaux canadiennes, notamment les eaux internes, sauf pour mouiller l’ancre conformément au droit de passage inoffensif en vertu du droit international,

(ii) s’agissant d’un aéronef, que celui-ci n’a pas atterri alors qu’il se trouvait au Canada;

f) la personne qui arrive à bord d’un bâtiment au sens de la Loi de 2001 sur la marine marchande du Canada, à condition que le bâtiment ait quitté son point de départ à destination du Canada au plus tard le jour de la prise du présent décret.

5 Il est entendu que le présent décret ne porte pas atteinte aux pouvoirs et aux obligations prévus par la Loi sur la mise en quarantaine.

Cessation d’effet

31 janvier 2022

6 Le présent décret cesse d’avoir effet le 31 janvier 2022 à 0 h 01 min 0 s, heure normale de l’Est.
