Whereas the Minister of Transport, as the appropriate Minister, has consulted the board of directors of VIA Rail Canada Inc. with respect to the content and effect of this directive;

Therefore, Her Excellency the Governor General in Council, being of the opinion that it is in the public interest, on the recommendation of the Minister of Transport, pursuant to section 89 of the Financial Administration Act, directs VIA Rail Canada Inc.,

(a) to procure the incorporation under the Canada Business Corporations Act of a wholly-owned subsidiary, yet to be named, the mandate of which is to develop and implement the High Frequency Rail project, including the design, construction, financing, operation and maintenance of passenger rail services in Ontario and Quebec through one or more agreements with the private sector, in cooperation with the Minister of Transport;

(b) to provide all necessary support, expertise, and co-operation to the subsidiary to facilitate the subsidiary’s role and fulfillment of its mandate; and

(c) to provide all necessary support, expertise, and co-operation to the Minister of Transport to facilitate the Minister’s role in the development and implementation of the High Frequency Rail project.

Attendu que le ministre des Transports, à titre de ministre de tutelle, a consulté le conseil d’administration de VIA Rail Canada Inc. en ce qui concerne la teneur et les effets des présentes instructions,

À ces causes, sur recommandation du ministre des Transports et en vertu de l’article 89 de la Loi sur la gestion des finances publiques, Son Excellence la Gouverneure générale en conseil, estimant qu’il est d’intérêt public de le faire, donne à VIA Rail Canada Inc. les instructions suivantes :

a) constituer, en vertu de la Loi canadienne sur les sociétés par actions, une filiale à cent pour cent qui reste à nommer, ayant comme mandat le développement et la mise en œuvre du projet de train à grande fréquence, notamment la conception, la construction, le financement, l’exploitation et l’entretien de services ferroviaires voyageurs en Ontario et au Québec au moyen d’un ou de plusieurs accords avec le secteur privé, en collaboration avec le ministre des Transports;

b) fournir à la filiale l’appui, l’expertise et la coopération nécessaires pour faciliter son rôle et l’exécution de son mandat;

c) fournir au ministre des Transports l’appui, l’expertise et la coopération nécessaires pour faciliter son rôle dans le cadre du développement et de la mise en œuvre du projet de train à grande fréquence.
